Warranty Statement:

HGS guarantee shall be limited to the terms set out on the label. The Directions for Use of this product must be followed carefully. The buyer or user assumes the risk to persons or property arising from the use or handling of this product and accepts the product on this condition. HGS warrants that the product conforms to the product description on the label and is reasonably fit for purposes stated on such label only when used in accordance with directions under normal use conditions and when stored as well as handled in a manner that does not adversely affect the product’s performance. It is impossible to eliminate all risks inherently associated with the use of this product such as weather conditions, presence of other materials, storage conditions, or the manner of use or application, all of which are beyond the control of HGS. HGS is not liable for consequential, special or indirect damages resulting from the use of or handling of this product. All such risks shall be assumed by the buyer or user. Except as provided in this Warranty Statement, no other express or implied warranties (including any implied warranty of merchantability or fitness for a particular purpose) are made. No agent or representative of HGS is authorized to make any warranty or representation beyond those contained herein.  To the extent consistent with applicable law, or as otherwise agreed between the parties in a separate written agreement, the exclusive remedy of the buyer for any and all claims, losses, injuries or damages resulting from the use or handling of this product shall be the return of the purchase price of this product, or at the election of HGS, the replacement of the product. These conditions shall be interpreted in accordance with the laws of the State of Florida, excluding its conflicts of laws rules.
